1. ACCEPTANCE OF TERMS
By accessing and using the Sipher website (siphertraining.com), booking services, attending workshops, or participating in training programs, you ("Client," "Participant," or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services or website.
These Terms apply to all services provided by Sipher, including but not limited to individual coaching sessions, group workshops, sound healing sessions, mobility training, mindset coaching, yoga instruction, football kicking specialization, and the Elite Specialist Camp.
2. DESCRIPTION OF SERVICES
2.1 Mind-Body Performance Coaching
Sipher provides mind-body performance coaching services for high school and college athletes, including:
Mobility training and movement optimization
Mindset coaching and meditation instruction
Yoga for athletes
Sound healing and recovery sessions
Individual and group training programs
2.2 Football Kicking Specialization
Specialized services for football kickers and punters, including:
Technical kicking and punting instruction
Integrated mind-body training for specialists
Elite Specialist Camp programs
Individual and group specialist development
2.3 Workshops and Events
Group training experiences including workshops, seminars, and special events focused on athletic performance enhancement.
3. ELIGIBILITY AND PARTICIPATION
3.1 Age Requirements
Participants must be at least 14 years old to participate independently
Participants under 18 must have written parental/guardian consent
Parents/guardians may be required to sign additional waivers for minors
3.2 Health and Fitness Requirements
Participants must be in adequate physical condition to participate in athletic training
Participants with medical conditions must obtain physician clearance before participation
Participants must disclose any relevant health conditions or injuries
3.3 Athletic Background
Services are designed for competitive athletes (high school and college level)
Participants should have basic understanding of their sport and training demands
4. BOOKING AND PAYMENT TERMS
4.1 Session Booking
All individual sessions require advance booking and confirmation
Cancellations must be made at least 24 hours in advance for full refund
No-shows or cancellations within 24 hours forfeit the session fee
4.2 Workshop and Event Registration
Workshop registration requires full payment at time of booking
Cancellations more than 7 days before event receive full refund minus processing fees
Cancellations within 7 days of event are non-refundable but may be transferred to future events
4.3 Elite Specialist Camp
Camp registration requires full payment at time of booking
Cancellations more than 14 days before camp receive full refund minus processing fees
Cancellations within 14 days are non-refundable but may be transferred to future camps
Weather-related cancellations will be rescheduled or refunded
4.4 Payment Methods
We accept major credit cards and electronic payments
All fees are in US dollars
Payment processing is handled by secure third-party providers
5. LIABILITY AND ASSUMPTION OF RISK
5.1 Assumption of Risk
Participants acknowledge that athletic training, physical movement, and sports activities involve inherent risks of injury. By participating in Sipher services, you voluntarily assume all risks of injury, illness, or damage that may occur during or as a result of participation.
5.2 Release of Liability
Participants agree to release, waive, discharge, and covenant not to sue Sipher, its coaches (Stacie Cannon and Scott Cannon), employees, agents, or representatives from any and all liability, claims, demands, or causes of action arising from participation in services.
5.3 Medical Emergency
In case of medical emergency, Sipher reserves the right to secure appropriate medical treatment at participant's expense. Participants authorize such treatment and release Sipher from liability related to emergency medical decisions.
5.4 Limitation of Liability
Sipher's total liability for any claims arising from services shall not exceed the amount paid by the participant for the specific service in question.
6. PARTICIPANT RESPONSIBILITIES
6.1 Health and Safety
Follow all safety instructions provided by coaches
Inform coaches of any injuries, pain, or medical concerns immediately
Participate within your physical capabilities and comfort level
Maintain proper hydration and nutrition
6.2 Equipment and Attire
Wear appropriate athletic clothing and footwear
Bring required equipment as specified for services
Use equipment safely and as instructed
6.3 Conduct and Behavior
Treat coaches, staff, and other participants with respect
Follow facility rules and guidelines
Refrain from disruptive or inappropriate behavior
No use of alcohol, drugs, or tobacco during services
7. INTELLECTUAL PROPERTY
7.1 Content Ownership
All training methods, instructional materials, videos, written content, and proprietary techniques used by Sipher are the intellectual property of Sipher and its coaches.
7.2 Restrictions on Use
Participants may not:
Record, photograph, or video training sessions without written permission
Share, distribute, or reproduce proprietary training materials
Teach or demonstrate Sipher's methods without authorization
Use Sipher's name, likeness, or methods for commercial purposes
7.3 Participant Image and Likeness
Sipher may photograph, video, or otherwise document training sessions for promotional, educational, or testimonial purposes. Participants consent to such use unless specifically declined in writing.
8. PRIVACY AND CONFIDENTIALITY
8.1 Personal Information
We collect and use personal information as outlined in our Privacy Policy. By using our services, you consent to our privacy practices.
8.2 Health Information
Any health or medical information shared with coaches will be kept confidential and used only for training purposes, except as required by law or emergency situations.
8.3 Training Information
Details about your training, progress, and performance may be discussed among Sipher coaches for the purpose of providing comprehensive service.
9. CANCELLATION AND REFUND POLICY
9.1 Individual Sessions
24+ hours notice: Full refund or rescheduling
Less than 24 hours: No refund, rescheduling subject to availability
Coach cancellation: Full refund or priority rescheduling
9.2 Workshops and Events
7+ days notice: Full refund minus processing fees
Less than 7 days: Transfer to future event or store credit
Event cancellation by Sipher: Full refund
9.3 Camps and Intensive Programs
14+ days notice: Full refund minus processing fees
Less than 14 days: Transfer to future program or 50% refund
Weather cancellation: Rescheduling or full refund
9.4 Processing Fees
Refunds may be subject to payment processing fees charged by third-party providers.
10. WEBSITE TERMS
10.1 Acceptable Use
Use website only for legitimate purposes related to our services
Do not attempt to breach security or access unauthorized areas
Do not use automated systems to access or download content
10.2 Content Accuracy
While we strive for accuracy, website content is provided "as is" without warranties. Information may change without notice.
10.3 Third-Party Links
Our website may contain links to third-party sites. We are not responsible for content or practices of external websites.
11. MODIFICATIONS TO TERMS
Sipher reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with the effective date. Continued use of services after changes constitutes acceptance of new Terms.
12. TERMINATION
12.1 Termination by Participant
Participants may terminate services at any time subject to cancellation policies outlined above.
12.2 Termination by Sipher
Sipher reserves the right to terminate services for participants who:
Violate these Terms
Engage in inappropriate or disruptive behavior
Pose safety risks to themselves or others
Provide false information about health or eligibility
13. DISPUTE RESOLUTION
13.1 Governing Law
These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles.
13.2 Dispute Resolution Process
Informal Resolution: Disputes should first be addressed directly with Sipher management
Mediation: If informal resolution fails, disputes will be resolved through mediation
Arbitration: If mediation fails, binding arbitration will be used
Jurisdiction: Any legal proceedings will be conducted in Washington County, Oregon
13.3 Class Action Waiver
Participants agree to resolve disputes individually and waive the right to participate in class action lawsuits.
14. GENERAL PROVISIONS
14.1 Entire Agreement
These Terms constitute the entire agreement between participant and Sipher regarding services.
14.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
14.3 Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
14.4 Assignment
Participants may not assign rights or obligations under these Terms without written consent.

16. ACKNOWLEDGMENT
By using Sipher services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. You also acknowledge that you have been advised to consult with legal counsel if you have questions about these Terms.
